Terms and Conditions of Sale

These Terms and Conditions ("Terms") govern the sale of original paintings and art prints ("Products") by the seller ("we", "us", or "our") through this website to customers in Canada. By placing an order, you ("you", "your", "the customer") agree to be bound by these Terms in accordance with the laws of Ontario and applicable federal laws of Canada.
1. Products
We offer original artworks and fine art prints. We make every effort to display the colours and images of our products as accurately as possible. However, we cannot guarantee that your device's display will reflect the true colours of the Products.
2. Orders and Acceptance

All orders are subject to availability and acceptance.

We reserve the right to cancel or refuse any order at our sole discretion, including in cases of suspected fraud, incorrect pricing, or errors in product information.

Once an order is placed and accepted, you will receive a confirmation email.
3. Pricing and Payment

All prices are in Canadian Dollars (CAD).

Prices are inclusive of applicable Ontario sales tax (HST) unless otherwise stated.

Full payment is required at the time of purchase via the accepted payment methods at checkout.

Prices and availability are subject to change without notice, but once your order is confirmed, the price will not change.
4. Shipping and Delivery

Products are shipped within the time frame stated on the product listing.

Delivery times may vary and are estimates only.

We are not liable for delays caused by shipping carriers, weather events, customs, or other external factors.

You are responsible for providing accurate shipping information. Orders returned due to incorrect address may require an additional shipping fee to be resent.
5. Refund Policy
All sales are final. We do not offer refunds or exchanges for any reason, including:

Personal preference or aesthetic issues
Please review your order carefully before completing your purchase.
6. Damaged or Incorrect Prints
If your print arrives damaged or incorrect, you may request a replacement under the following conditions:

You contact us within 7 business days of receiving your order.

You provide your order number and clear photographic evidence of the issue.

The replacement will be shipped at no cost to you once the issue is confirmed.
Note: This policy applies to prints only. Original artworks cannot be replaced, as each is one-of-a-kind. For damaged originals, we will work with you to determine a fair solution.
7. Intellectual Property
All content on this site, including artwork, images, and text, is the intellectual property of the artist. You may not reproduce, modify, resell, or use any content for commercial purposes without written permission.
8. Limitation of Liability
To the fullest extent permitted by Ontario and Canadian law:

We are not responsible for indirect, incidental, or consequential damages.

Our total liability shall not exceed the amount paid by you for the product(s) in question.
9. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes will be resolved in the courts of Ontario.
